I live in the state of Florida. My brother has proven to the family that he can not be trusted and greed has taken over. His wife works for a large legal firm and has cheated my mother out of a large inheritance without her knowing until this person whom was suppose to leave things to my mother died. Mom even has a will saying so but my brother and his wife have an UPDATED will. My mother has told my brother that she is leaving everything to me (her daughter). My mom has signed a quit claim deed leaving everything to me. I am confused about how this works. She was told that upon her death all I have to do is call her attorney and tell them to filed the deed and it will be in my name starting on the date she SIGNED the quit claim and my brother can have no claims to the home. Is this true or is there a way that my brother can worm his way in and put a claim on the house?

Hi,

As you say, your mother leaved whole property to you by quit claim deed. Is this quit claim deed recorded in to country records & its validated? If you confirmed about that, then there are no way for your brother to claim property. If this quit claim deed not validated then your brother have some chances to get claim on property. If you not confirmed about deed validation, contact your attorney & record this deed in country records to make it validate. Keep in touch with your attorney.

Not validated yet, will be upon her death. She was told that when we do validate it, it will be dated for the date that she signed it, not the date of her passing. If we do it now all her senior citizen benefits she gets on property taxes will stop.

Hi,

It's so risky, you have to contact your nearest country record office & ask them for record this deed. I hope will done fine, once deed recorded you legaly mentioned on property deed then you will be the owner of property, Senior citizen's benifits & advantage will not be carry over to you so forget about that benifits.

You have to record this deed earlier. If deed not be validate, there are more chances to loose home. You brother will get pluse point to claim property so record thisdeed earlier.
