My sister Phuong Luu and my uncle Phat Nguyen are under the title to their house in FL. Phuong is under the deed to the house and my uncle Phat just cosign it because we did not have enough credit. Now we want to remove him from the house's deed and my uncle has agree to it. If I want to do a quit claim deed, how will that work out? How much will it cost me? I live in Florida.

Hi saluu!

Welcome to forums!

Your uncle will have to sign a quit claim deed and transfer the property to you and your sister. You can contact an attorney and he will help you in drafting the quit claim deed. While filling out the quit claim deed, your uncle's name will be mentioned as the grantor whereas your name and your sister's name will be mentioned as the grantee. The cost of the deed may vary from one lawyer to another. As far as the mortgage is concerned, you and your sister will have to refinance it once the property transfer is complete.

Sussane,

Can I still do the quit claim deed if I don't want to put my name into the title but I just want to take my uncle (Phat) out of the title and just leave my sister(Phuong) as the sole owner? What if my sister(Phuong) credit is poor, is it poossible to do a quit claim deed?

As far as I know, you are presently not on the property deed. In that case, you don't have to sign a quit claim deed. Your uncle can sign a quit claim deed and transfer the property to your sister. If your sister is the sole grantee, then she would be considered as the only owner of the property.
