2ND MORTGAGE

There is a SECOND MORTGAGE on my home in florida. this second mortgage is not under my name, it does not appear on my credit report. this loan has been past due since december 2008. WHAT ACTIONS CAN THEY TAKE AGAINST ME?

can someone please help me?

Who has the 2nd mortgage in thier name? is it your husband?

Hi Guest,

If the second mortgage is not in your name and you say it does not appear on your credit report, I don't think they can take any action against you. However, they can obviously obtain a judgment against the person who is on the loan.

come on now people...if there is a lien on a house, it doesn't matter who the borrower is. it's still a lien, and that lien can be enforced by the lender if payments are not made. ex-boyfriend, spouse, uncle, cousin, best friend in kindergarten - it matters not who signed the note. the key element here is the lien.

worried...you need to be worried. if he won't make payments, then you had better find out what is happening so you can protect yourself. if the bank won't speak with you because it's not your loan, then you need to somehow get your ex-b/f to provide you with the necessary information or make the payments or give you a coupon book so you can make payments. your home is in jeopardy.

I dont' think the sky is falling here. They can't foreclose on you from the 2nd lien position.

You do need to get your ex-boyfriend on the phone with the lender to straighten out this situation with them. Are you not able to afford that payment anymore?

we took a second mortgage about a year ago. We stopped payments on it right after 2 month. We never received a bill,call or any warning after that. We look at our credit reports and see no information about it. Nothing! What happened? Can somebody explain?
