A co-owner of my FL condo - on deed but not on mortgage - does not want to be reached and will not answer any form of communication. She does not appear on death records in the county she used to live in. I need her signature to sell the condo. What can an attorney do for me? Better yet, how can I solve this problem without an attorney? I've never missed a mortgage payment, but starting in April I can no longer pay and really must put it on market now.

Hi Guest,

You can try to buy out your co-owner. You can pay her a certain sum of money and ask her to quitclaim the property in your name. If she does not agree to this, then you can file a partition law suit. Once you file this lawsuit, the court will order the sale of the property. After the property is sold, the loan will be satisfied first and the excess amount, if any, will be distributed between both of you.
