Just served foreclosure papers

I am confused, hope someone can help. I live in Florida. I have been just served foreclosure paperwork. My wife was a non borrower on this loan. She has quit claim deeded the condo to me this past June.

Why was she served foreclosure paperwork? Is it because they are unaware that she is no longer on the property as an owner. I have 20 days to respond and concerned she will be affected by this foreclosure.

If she responsible in anyway? Can she be sued? Please let me know, I have been unemployed for 2 years and need assistance.

Hi Guest,

As your wife's name is not mentioned on the mortgage or on the property deed, the lender should not send the foreclosure papers in your wife's name. You should immediately contact the lender and ask them to withdraw the papers that they have served to your wife. As her name is not mentioned on the loan, she won't be affected in any way due to the foreclosure.
