HI I PURCHASED PROPERTY FROM SOMEONE AND DID NOT GET IT FILED IN THE COURTS I PAID HIM IN FULL AND THEN FOUND THAT HE HAD A MORTGAGE AGAINTS THE PROPERTY HE DID NOT PAY OFF THE LOAN IN THE PROCESS THE PERSON DIED AND NOW THE HOUSE IS IN FORCLOSURE AND THEY HAVE GIVIN ME A AVICTION DATE I FOUND HIS MOTHER HE HAVE OTHER PROPERTY THEY ALL HAVE MORTGAGES AND SHE IS OVER HIS ASTATES HOW DO I GO BY TO DO A SIMPLE ASSUMPTION WITH HER TO STOP MY AVICTION THANKS....

Hi TOYS,

Do you want to assume the loan and take over the responsibility of the mortgage? You can definitely do that if you qualify for the assumption. You can also refinance the existing mortgage in your name. However, before you take over the responsibility of the mortgage, you must make sure that you have the title in your name. Otherwise, you will remain responsible for the loan after the assumption or refinance, while you will have no interest in the property.
