Foreclosure Eviction

Posted on: 25th Feb, 2010 01:44 am
Hello,

My home has been foreclosed, and I recently received a "Final Order Of Ratification" from the Circuit court in Maryland. How long do I have before I receive an eviction notice? Also, once I receive the eviction notice, how long will I have to move out?

Thanks
Hi sholz,

As far as I know, you would get 3 days time to leave the property after you receive the eviction notice. You will have to vacate the property within these 3 days.

Thanks

Sholz, Well here in California, I was renting a house that went into forcloser. I stated until the last moment. Papers got posted and posted, the one you pay attention to is a two page letter from the court..front and back and on the back it tells you, that you have 10 days to respond...if you respond that usually buys you another month or so... then you go to court, the bank guy came around and I got another 18 days and after that the sherriffs came and I got another 5 day or 7 if it was the weekend ...so over all I got 14 months rent free...sit and just look around your neighbor hood and ask question.. i am sure your not the only one in this mess.
As far a the three day notice..if you don't do it then the landlord would then go file papers at the court house to try and get your removed... you then respond back... get a court date (usually 3 weeks or longer) and then if the landlord is doing something wrong ..like ??? you might win and he will have to start over... you stay. Goodluck.

Welcome George,

As far as I know, after the property is sold off at a foreclosure auction, you will get a notice of eviction immediately. Generally, it's a 3 day notice and you'll have to move out of the property within that time limit.

Hi clinttt,

You can contact your lender and apply for a loan modification immediately. This will help you in stopping the eviction process. If your request is accepted, it will help you in saving the property.

Hi adrian!

Welcome to forums!

The lender will send you a notice of eviction wherein the date within which you need to leave the property will be mentioned. You'll have to leave the property within that given period of time.

Feel free to ask if you've further queries.

I just found out our house was sold in a foreclosure auction, thinking that i'm in the middle of loan modification. what can I do or how long do I have before I have to get out of the house. I didn't even get a letter saying my house was sold. i have no place to go right away, how long can I stay at my house?

Welcome kiks,

The lender should provide you with a letter about the foreclosure prior to sale of the property. If he has not done so, then they would be considered as illegal. You need to contact an attorney and take legal actions against him.

Hi luz!

Welcome to forums!

If you pay off the dues before the property is sold off at a foreclosure sale, then the lender cannot evict you. Once you pay off the dues, the lender will stop the foreclosure.

Hi Elver!

Welcome to forums!

You will have to apply to Fannie Mae if you want to rent the property. It will be completely Fannie Mae's discretion whether or not it would let you rent the property.

Feel free to ask if you've further queries.
