Greeetings@
How do I homestead my home to protect it from foreclosure, judgements or bankruptcy if I have to file. It is not part of my mortgage. I am disabled

Hi Ruth Clark!

Welcome to forums!

In order to qualify for homestead, you will have to one of the owner's of the property of the property or a qualifying relative of the owner. You will also have to occupy the property as a primary residence.

In order to file homestead, you will have to contact the County Property Records and Taxation office. You will have to provide them with the names as well as the Social Security Numbers of all the owners. You will also have to file a Certificate of Real Estate Value.

Homestead exemption is designed to protect the value of the homes of residents from creditors, property taxes, as well as circumstances arising from the death of the homeowner spouse. Homestead exemption laws are known for 3 primary features. It prevents the forced sale of a home to meet the demands of creditors. It provides the surviving spouse with shelter. It also provides an exemption from property taxes which can be applied to a home.

As far as I know, Homestead exemptions are available in Oregon. However, homestead laws vary from state to state so you can consult an attorney who will help you in understanding the whole thing.

Can I homestead my home now because I lost a lawsuit and expect the other party will sue me for attorney fees?

You claim your property as homestead by going to your tax office and completing a homestead exemption form. Nothing to it. It may eve be avaliableo online and you can mail it in.

My civil case will go on trial in Jan 2010, and it looks like they will win. Can I homestead my home now? I am disabled and on SSI so money is tight.

You can apply for a homestead now. However, applying for homestead just to save the property from a judgment may be considered as a fraud. Consult your attorney before taking any step.

I own a mobile home which I paid for with my inheritance. mywife is a joint tenant so she can live here after my death. I am disabled and she owes taxes from before we were married in 06. Can I homestead the mobile to protect it from bankrupcy or from the IRS. It is all we have and is over 40 yrs. old

If you're the owner of the property, then you can definitely apply for a homestead. You will have to contact the tax office in order to file homestead.
