Lived with friend from May 2008 to February 2009...I gave friend house payment money every month...........I found out in December that she had not paid the mortage since September. The last payment I gave her was in December and moved out in February 2009.

She is still living in the house and has made one mortgage payment since September of 2008.

I have since purchased my own home and live on my own. I received a summons today from the lendor on the mortgage of the house she still lives in.

Am I liable for not paying the mortgage payments?

Hi yankya,

Is your name mentioned in the mortgage docs? If not, then you would be held liable for the mortgage payments. Moreover, the foreclosure on your friend's property will not effect you. However, if you are a co-borrower of the loan, then the foreclosure will definitely affect you. It will lower your credit score by 250 points and will be mentioned in your credit report as a negative item for the next 7 years.

I assume you are not on the mortgage, but are on the title. In that case, you would still be named as a defendant in the foreclosure action, since they must name everyone on title. If you do not owe on the mortgage, you should file a quitclaim deed immediately and send a copy to the suing attorney and demand to be dismissed from the case. Otherwise, it may go on your credit history.

Hi fe,

You will have to contact the county recorder's office in order to file a quitclaim deed. You can contact an attorney and he/she might also assist you in this matter.
