Can we take the fence during foreclosure?

We are losing our home to foreclosure. May we remove the chain link fence we added after we moved into the home? It was not part of the mortgage and does not touch the house.

Hi Guest,

As you added the chain link fence on your own, you will be able to remove it when you leave the property. As it was not included in your mortgage, your lender won't be able to say anything in this regard.

Hard to imagine why a fence would not be considered “real estate” if the post were sunk in the ground. “After acquired” is not relevant; for example you put on an addition, it’s covered by the mortgage even if the construction is done after the mortgage is recorded.

As a practical matter, I don’t see many repercussions if you simply take the fence. Even if you have a video tape of the former owners “stripping the house” after the foreclosure sale, police won’t do squat – that would “hurt” the poor soul whose house was “taken away from him”.

No. Anything you've purchased and "attached" to the property is considered "real property", and stays with the house. That includes faucets, air conditioning units, heaters, lighting fixtures, carpet, etc.
