Name on deed but not on mortgage.

My husband and I are purchasing a property in Ohio, the mortgage is going in his name only, can the property be deeded in his name and mine?

Welcome kay,

Both of you can add your names to the property deed though the mortgage is in your husband's name.

My husband has owned our home for over 23 years we refiananced three years ago but my credit was not too good so we decided that he would get the loan in his name only for a better rate. He passed away in May my name is on deed but not loan there is no will do I need to get the mortagage in my name or just keep paying in his name

Hi cathy,

It will be better if your could refinance the mortgage in your name and then pay off the mortgage debt.

i am recently divorce and have my home which i am not on the mortgage but on the deed .my ex husband was suppose to pay the mortgage with our separation agreement but havent.i was wondering what can i do to save the house it's in pre forclosure and the mortgage company will not discuss anything with me since im not on the loan.

Hi Guest!

Welcome to forums!

As per the agreement, your ex has to pay the mortgage. You should contact your ex and ask him to make the payments asap so that the foreclosure can be stopped. If your ex does not do so, then you will lose the property. However, the lender won't come after you to recover the deficient balance resulting from the sale of the property. As your ex's name is mentioned on the mortgage docs, the lender will go after him to collect the deficient balance.
