I have a Nov 17 court date for the sale of our house. We are in review for a Fannie Modification for our loan. Could the judge hold up the sale date for some time , because the mortgage company (bank of america) said it would take 90 days to review. the sale date for the house is 12-8.

Hi,

You can request the judge to allow you some time as you've been trying to do a loan modification in an attempt to save the house. In most of the cases, the judge gives the decision in borrower's favor if he thinks the borrower is doing his best to save the home. You will have to offer evidence in support of your claim that you're trying to get your loan modified. If the judge feels you are desperate to save the house, he can postpone the date of sale of the house.
