If a home association has tried to foreclose on your home by stating attoeny fees owed. But there is no judgment then if my husband becomes the judgment debtor and he unknowingly transfers the tittle to the association and this association gains the tittle and then pays on his mortgage loan what do you call this,,,,,and is it legal if I as his wife still have equity in the property and am divorcing him that is my husband.

Hi reneelorraine!

Welcome to forums!

If your name is on the property deed, then your husband will not be able to transfer the property to the homeowners association without your signatures. If he has done so, then it would be considered as illegal. If your name is not on the property deed, then your husband can transfer the property to anyone he feels like.

Feel free to ask if you've further queries.
