This person paid off the property but did not receive the deed. She has resided on this property for approx. 28 years, paying property tax, etc. Has made improvements and recently purchased a new mobile home that was moved on the above property to replace the previous mobile home.

Hi dneugebauer,

As far as I know, you need to occupy the property for at least 7 years to claim adverse possession rights in the state of Georgia. Since the person mentioned in the post occupied the property for the past 28 years and paid taxes and other property related obligations, she can claim her rights in the property through adverse possession. However, it is better to consult a real estate attorney in this regard.

MY NEIGHBOR MOVES A FENCE when I am away, and immediately plant on my land . the seven years is about up. I am a widow ,living alone and do not want to start a fight with them. How can he own the land by secretly moving my fence???

I lived and grew up in my mothers house she died recently the house still had a loan on it from a loan my mom took out on the equity. The house is now going under foreclosure i paid the taxes and paid for other things while i lived there i want to keep the house in the family what do i do can i do an adverse possession

Welcome to forums!

Rather than going for an adverse possession, you can file an affidavit of heirship at the county recorder's office and get the property transferred in your name. Then, you can refinance the mortgage in your name.

That person that you are referring has the rights to own the property since he or she has done all the qualifications of owning the rights of a property.
