Like 0 Dislike 0 My name is on the deed to my house, my husband's is not. Both our names are on the mortgage. We are going to be going through a divorce, he refuses to leave. Do I have any claim to the house? Can I make him leave? I am in Georgia.

Your husband will not be considered as the owner of the property. Thus, you've all the rights to ask him to leave the house. As far as the loan is concerned, you can refinance it in your name.
