home was quit claim deeded to me from my mom then mom turned around and sold the home to another party without a clear deed. mortgage was in moms name due to credit issues on my behalf but deed was in my name as well as taxes came in my name. new owner person mom sold home to evicted me from home causing me to lose all posessions entire 3 bedroom house fully furnished with 16 years of my belongings and my sons lost it all. then new owner finally found out he couldnt get a deed cause the deed was in my name and by this time the payments were so far behind i couldnt catch them up so i signed the quit claim deed over to him but not before gatting him to sign an agreement to compensate me for all my lost belongings and stating the circumstances that led to me losing everything such as being evicted by him without a clear deed and he signed and it was notorized.what can i do legally to collect from him and where do i go for help in georgia? help me please

Welcome to the forum.

Is it that the new owner has only signed the agreement but has not compensated you as it is stated in the agreement? Is he denying now to compensate you? If so then you should consult with an attorney and file a lawsuit against this person.

Hi happynonchatter,

It's good that you took some action and made the person compensate for all your belongings. But the fact remains that the new owner now has the property but the loan is still in your mom's name. So she is still responsible for the payments.

Now what has been the lender doing during the sale? Does he know about it at all? I suppose if he comes to know, he might take some steps or may call the loan due. However, this will depend more upon what is stated on the loan doc regarding transfer of property during the loan term.

The best thing is, to ask the new owner to refinance the loan in his name. if he doesn't agree to it, you will have to consult a mortgage attorney for any legal action to be taken on your part. Otherwise, if your mom cannot pay and he too is not bothered, it is sure to affect your mom's credit.
