My father second marriage, four children, Property (home) in deceased wife's name (no will). Do my father have any right's to this property in Georgia?

Hi gadriennethornton,

Welcome to mortgagefit,

As long as your father is able to prove the marriage documents he can claim some portion of the property by the process of 'probate' once his wife is no more.Or else his wife can get a will done immediately and thus can divide the property accordingly.
