I own a property with my sibling in GA. My sibling wants to refinance and I want to be removed from the mortgage and the deed. My sibling wants to do a streamlined refinance. The company doing the streamlined refinance wants me to file a Quit Claim Deed which would be processed at the time of the refinance. Does this sound correct? Why can't I just sign a power of attorney for my sibling to sign for me at the time of the refinance where everything would then be in my sibling's name?

Hey replenishusoulpurpose,

Normally people prefer signing a quitclaim claim deed in order to remove one's name from the property deed. Once this quitclaim deed is recorded, the other person can refinance the property in his/her name. If you want to sign a power of attorney to your sibling, then you can speak to the lender about this. If he agrees to it, then you can go forward.
