Transfer house and refinance?

My brother is in jail and I need to get his house in my name. I will be paying the mortgage with his pension under POA. Do I have to get the mortgage refinanced or can I leave it in his name? How do I get the house in my name. He lives in Georgia.

Welcome to forums!

In order to get the property transferred in your name, you will have to ask your brother to sign a quitclaim deed. Contact an attorney and get the deed drafted from him. As far as the mortgage is concerned, I think you will have to refinance it in your name though you have a POA. You should contact the lender and take his opinion in this issue.
