Like 0 Dislike 0 My brother is in jail and I need to get his house in my name. I will be paying the mortgage with his pension under POA. Do I have to get the mortgage refinanced or can I leave it in his name? How do I get the house in my name. He lives in Georgia.

In order to get the property transferred in your name, you will have to ask your brother to sign a quitclaim deed. Contact an attorney and get the deed drafted from him. As far as the mortgage is concerned, I think you will have to refinance it in your name though you have a POA. You should contact the lender and take his opinion in this issue.
