i answered your question, which was essentially the same one, in the forum. but now i understand your motivation...what he's done could be considered mortgage fraud, but i'm sorry to say that it might not benefit you whatever. if the lender should deem it necessary, they could conceivably take action; but the bottom line for the lender is getting their money back, so what action they might be able to take would quite possibly not be productive in that sense. if you are still in the home and he isn't, then they'll look to you first, and him second, for repayment. if they don't get what they're looking for in terms of the repayment, they'll take action. and, of course, that action could involve a foreclosure, etc. i regret i haven't been able to shed any favorable light on this topic, but hope you'll be able to achieve some satisfaction soon.
