I Live in Hawaii. If I file chapter 13 can I keep my rental property which provides income and also keep my home? The rental property is in default.

How do I protect my home? Do I need to homestead it?

Hi Joanie,

Chapter 13 helps you in reorganizing your debts. If you include your property in your bankruptcy filing, you will get a repayment plan from your lender. You will have to pay off your dues as per the plan within 3-5 years. Thus, you would be able to protect your home.
