Hawaii foreclosure

I received non judicial foreclosure notice, then several months later I received a judicial complaint/summon. Is the judicial complaint valid considering that the lender already issued non judicial notice at the beginning?

Hi jojo,

I would suggest you to contact a Hawaii based attorney in order to find out if the lender can send you both the non-judicial as well as judicial foreclosure notices. He would be the best person to help you in this matter.

Thanks! Is there a trusted lawyer website out there that I can look to find Hawaii based lawyer? I need to ask also if its valid for the lender to purchase the foreclosed property and what if the lender purchase it at a lower value?

and by the way. I'm now living here in Maryland but the foreclosed property is in Hawaii. Do I get a lawyer from Hawaii (where the property is)?

As the property is located in Hawaii, you will have to contact a lawyer based at Hawaii. You can find out lawyers based at Hawaii from the given page:

I have a condo in hawaii original loan countrywide now b of a. Ive been told by a lawyer that its a non judicial mortgage and they cannot come after me except for the property itself. I lost my down payment of 175k and countless dollars and time fixing it up. Its upside down by about 40-50k. Please help me as Im not even sleeping lately

Welcome alan,

As far as I know, Hawaii is a non-recourse state. The lender will not be able to come after you in order to recover the dues after the property is sold off at a foreclosure sale.
