my husbanddied with no will, and my name is on the deed, but not the mortgage. I have kept up all payments in his name, but since my name wasn't on the mortgage, the company says they cannot talk to me directly. I didn't tell them he died out of fear of losing the house (?) I am listed as the grantee on the deed and I would like my name on the moetgage. Is rhis possible?

Since your husband died without a will, it will have to go thru probate, you still own 50% of the home, keep making the mortgage payments during this process. Then once the probate process is over you will be able to refinance and put the mortgage in your name. I also recommend that you consult with an attorney as soon as possible.

i disagree, but that's not a bad thing. actually, our guest owns the whole house, not just 50%.

having an attorney is definitely beneficial; it will be easier to navigate through probate and with the mortgage process as well. i don't believe that telling the lender about the death of the husband will jeopardize our guest's ability to remain in the home.

I agree with George, as long as the payments are being made, telling the mortgage company would not jeopardize the ability to stay in your home. Telling them may even open up the line of communication.
