New Construction / refinance with FHA

I have a client who has been in their new home for less than a year. They had the home built and converted their loan to a 30 year fixed last August. Can they refi into an FHA 30 year fixed now being it is less than a year that they received a CO? I understand that the FHA requires the appraiser to document the time of occupancy.
