We have had the house for 2 years then got divorced could not sell the house as the prices were falling we agreed to keep the house untill the market improved.
I am the only one paying for the Mortgage and she has not contributed nothing towards the mortgage, for the last 2 years. and she has moved back to Australia.
Is there a leagl way to remove her name from the title (Mortgage) |

Hi Sbonshahi,
Welcome to forums.
Does your lender know that your wife has moved out without making her share of payments. I think she has her name on the loan too. So, she should be informing the lender before moving out of the property and the state. I think you should talk to the lender asap and avoid getting into further trouble.
In order to remove your ex-wife's name from title and mortgage, you'll have to refinance the loan in your name. And for the change in title, you'll need your ex's signature on the deed.

| yeah sbonshai home prices have been falling in several areas and home sales have also declined. So, finding a buyer in today's market is really tough. But how long do you intend to keep the home? |

The only way to remove her is to do a complete refinance in your name only. You'll have to qualify for the payment on your own merits. _________________ Chris Burns

Welcome to the forum Sbonshahi,
While a refinance might be entirely necessary, you should also contact your current lender to inquire about a novation. That would allow your existing loan to remain intact but remove your wife.
In order to qualify for the novation, the lender will look solely at your income and debt situation. The novation may be easier as your wife is out of the country.

Hi chin.
Welcome to the forum. If the house is paid off then there is no need to refinance or novation. Only if this is a mortgaged property then the grantee should refinance the mortgage on his name. Novation or mortgage assumption cost varies lender to lender and it will depend upon the amount of mortgage loan.
