The mortage is in my mothers name only but my name, my mother's name, and my husbands name are on the title of the house. Can I have his name removed from the title without getting divorced? We have been separated for over a year and a protective order is in place.

Hi Janet,

Yes, you could certainly have his name removed from the title without getting divorced and the way to do that is to refinance your mortgage and have the title on the desired person(s) name.

my husbands name is only on the title, and my name is not, but he wants got hand the house over to me, any suggustions?

Your husband can sign a quitclaim deed in order to get the property transferred in your name. Then you can refinance the mortgage in order to get it transferred in your name.
