Name not on mortgage

I am married and going through a divorce and we have a house between us with a mortgage. My name is not on the mortgage, only on the deed. Can a judge in any state overide a mortgage contract and make the person who's name is not on the mortgage responsible for the debt?

That's looks really starange. I do nto think the judge can do that unless you are claiming 50% or 100% of the house in the divorce.

Also this means the lender needs to agree for it

hi sommerbreeze,

if you are not on the mortgage, you do not have to bear the responsibility of repaying it. being only on the title does not make you liable to pay off the mortgage. however, if you want to retain the ownership of the house, the judge can order you to refinance the mortgage in your name and take over the responsibility of making the payments.

Welcome to our forum.

If your name is not mentioned on mortgage that means you are not responsible for paying to lender.

You name on deed means you have ownership of property.
