Back in July of 09 myself and my ex broke up. We own a home in Rantoul, IL. I signed the quit claim deed on August 10th under the promises made by herself that she would have the home refinanced within a month or two with the help of her Parents. Well her Parents do not want to help her because they say she makes very poor decisions.
i would like to know how do I go about getting this house out of my name and if I cant, how do I go about getting the home placed back in my name so I could seel it..

Hi gcoxhorizonhobby,

If you want to remove your name from the mortgage, then your ex will have to refinance the loan in her name. As far as adding your name to the property deed is concerned, you'll have to ask your ex-wife to sign a quit claim deed. Once she does so, you would become one of the owners of the property and then you can sell it off.

was the quit claim you executed a result of a divorce? was the decree for said divorce (if so) specific about what was to take place with the home? if those are yes answers, then you ought to go back to the court and revisit the situation. whoever represented you needs to assist you to get the situation rectified.
