My ex- (not ex-husband) and I seperated and he wants to walk away from the house and isn't going to pay anymore on the loan that is in both of our names. I asked him to sign a quit Claim Deed and he has agreed - does it have to be prepared by an attorney in the state of Illinois? or can I prepare it myself? And will the mortgage company make me refinance because of this - I don't want to have to refinance for atleast another year.
