State of Indiana

My husband owns the property but his deceased wife's name is on the deed as his name and her name, deceased. He wants to make sure I get the property if he predeceases me. Do we need a quit claim or what?

Hi dianalyn!

Welcome to forums!

Your husband should file an affidavit of heirship and remove his deceased wife's name from the property deed. Once the property is solely transferred in his name, then he can sign a quitclaim deed and transfer the property to you or add you to the property deed.
