Lady bird deed

Posted on: 26th Nov, 2013 07:32 am
My father-in law drafted a new will and POA. His wish Was to remove her name from any and all documentation and put his son in her stead. Our lawyer requested all paperwork, titles and bank records. Everything was changed, filed with the courts and a done deal. My father in law passed away a month ago, yesterday we received a letter stating he signed a lady bird deed naming her as beneficiary back in 2009, but it was never filed with the county. Can we fight this? Did she perpetrate a fraud by withholding documentation for her own personal gain?
Hi Breezy,

Well, this is a complex situation. It will be better if you could immediately get in touch with your real estate attorney and take his help in this situation. He will let you know whether or not you will be able to take any legal actions in this regard.

Thanks
