The lender is foreclosing on your property because I am having problems making the payments. When I purchase this house I signed for a adjustable rate and the rates went up. I was not able to make the payments. The house was to be sold on 10/07 but this motion was filed by the plaintiff and I did not understand what it means. Do I get to keep my house or not? The order was granted the motion. I dont know if the court gave the parties their original documents back.

will, i'm sad o say but my father passed away 11/08/07 so we never got the chance to complete the forms for the rights of survivalship. what can i do in this case. he also owns another property that has no mortgage. He did not leave a will of any kind. Does everything that he owns automatically goes to his spouse or can his children contest his property in anyway

Hi jenkins,thanks for your answer, but is the cost basis the value of the property at the time of transfer or the granter cost plus improvements whichever is less? This would really affect the amount of capital gain calculation.
