Mr Heard, I appreciate your input. We are not represented by an attorney at present. I simply contacted the attorney that had handled our bankruptcy to inquire as to what was this "reaffirmation" that we never signed. I am leary of allowing him to handle anything else given that we had no information regarding a need to sign this reaffirmation or a lack of it being filed. I would be thankful if you could tell me if this reaffirmation has to be filed with the court. We would be ok with signing a reaffirmation immediately but I need to know if with an attorney's advice do we really have to reopen the bankruptcy or can we simply pay an attorney to advise us regarding it, sign it and return to the mortgage company?

I am in Texas and my husband is willing to transfer his interest in property to me. He's on the deed but not the mortgage loan. I have read that if there is a lien on the property we cannot use a Warranty Deed. Is this true? Do we have to do a Quit claim deed? Thanks, mchast3@yahoo.com

Joshua,I have some questions about my qualifying for a loan mod while being current on my mortgage. I am a responsible person so I want to stay current as long as I can. man, where have you been lately? we've been getting deed questions like never before, and i haven't seen your sage advice in quite a while? i know more than a little about the topic, but i certainly don't have a law degree (for that matter, i have no degrees). some of these questions being asked are dangerous in nature - primarily because some of the answers they'll get are about to make no sense whatsoever. i know you know what i mean. if you're stopping by soon, that's wonderful. it'd be great to see some reasonable answers to these queries.
