My father has done his will leaving the house to me. We would like to know can the deed to the house be changed to my name before death or after death. There is still a mortgage on the home. If this can't be done what procedures are necessary for this to happen since I will be paying the mortgage. Will the house remain in his name even thought I will be living there and paying the mortgage

Hi Beverly,

The name on the deed can be changed any time even though there is a Will. This can be done through a warranty deed. Also, the mortgage has to be transferred to you if you will be paying for it. This can be done through novation.

If your name has been added to the deed along with your father's, then both of you are the owners of the property. And, after your death, you will be the sole owner provided it is stated in the Will.

One more thing - you should inform the mortgage company or lender about your name being added to the deed. The deed should be notarized and then recorded at the Office of the County Recorder or the Register of Deeds, otherwise it will not be taken as valid.

you can in most states get a form call "Quick Claim Deed" complete the form and your dad can sign the property over to you some amount of monerty value is given (not less than $1.00) and file the deed with the court house in your town. Or better still check with a lawyer, or legal aide office in your town and they can help. It would be best to get legal help that could save problems later.
