I purchased a home with my ex-boyfriend at the end of 2007 later he filed for bankruptcy chapter 7 and was granted a relief from automatic stay in 2009. About a year ago, when I listed the property for a short sale, I found out that there are IRS and SOM liens attached to the mortgage acquired by my ex-boyfriend, therefore resulting in "cloudy title" and preventing me to proceed with the short sale. I have consulted with many attorneys and tried to file a release of the above mentioned liens based on a fact that the total liens against the property exceed its fair market value, but were unsuccessful. Another attorney had recommended a deed in lieu, but with liens attached I don’t think it is possible. Another catch is that it looks like my name was never recorded on a deed and is only on the mortgage. So far I lost three potential buyers because of “cloudy” title. The property is vacant. I have not paid for it more than 18 months and have not received any foreclosure notices. What do I do? How do I move on with my life?

Welcome to forums!

If your name is not mentioned on the property deed, then you may not be able to sell off the property though your name is on the mortgage. Moreover, in such a situation, it might be a bit difficult for the lender to foreclose the property.
