I want to move on but can't because my ex can not refinance the house they no longer live there and have been able to move on with their life so should i go to court and ask that she have it removed so that i can start my new life and family or just ask for the house back i have since gotten a new car so my ex's name would not be tied up i just want the same.

If the mortgage is still in your name, then you will either have to pay it off in full or you will have to sell off the property. This will help you in getting rid of it and move on.
