Is a public notice absolutely
required to be done when your filing or about to file a Heirship
Affidavit? I am sure the information going on it is correct. I think I
understand why public notices are done concerning estates, but I was also
getting the idea that they might serve as proof that you actually TRIED
to seek out unknown heirs if any. Someone please let me know if my
understanding is right.

Hi Guest,

Public notices are not offered to prove that someone tried to find out unknown heirs on the estate of a deceased person. These are provided at times, for instance when an attorney probates a Will. Such a notice informs the public that an administrator of the estate under probate is being appointed. This will allow the public to object to any such appointment.

Public notices are often offered to creditors so that they can start asserting their claims against the estate of a deceased person within a specific time period as otherwise, their claims may be barred.

That's quite true, one reason public notice is given is to inform everyone about the estate of the deceased and to put claims if eligible to get part of the estate's value.

does the affidavit protect the buyer from relatives of the selling party interfering with the sale of the property?

Welcome to the forums.

I guess the heirship affidavit does not protect the buyer from relatives of the selling party; rather it helps in removing a deceased owner's name from the property so that any rightful heir can attain ownership rights.

when you are buying the property you should use a Warranty deed to protect yourself from any kind of liens attached on the property. But I cannot understand why are you willing to use an affidavit of heirship. Please elaborate it Smile
