my husband passed away and the mortgage loan is only in his name how do i go about putting it in my name so i can leave the house to my son

Hello- You have to refinance to put the mortgage in your name. However, to accomplish your goal, that's not necessary. You could list your son as the heir to your house in your will.

If you want to transfer the mortgage in your name, then its better if you go for refinancing. If you want your son's name in the title of the house, then you need to file an Affidavit of Heirship in the county recorder's office.
