me and my ex-huband (husband @ the time) bought a home together bk in 2001. It was an hr and a half from my job, but he was in medical school and we had just planned to rent it out after med sch to other students. The location was great and thought it would be a great investment. Well, we have since divorced and the home is still being rented out. The $ in divided between us both, any maintance bills on the house is divided. In the divorce he wanted the house and is to pay my half of the home w/in 3 yrs, which will be the end of this year. But every year @ tax time i dread this because he will not give me a copy of the 1098 FORM. He said that i have no claim to the home. The loan is in just his name, the deed to the home is in both of our names. I have to claim the rental property, therefore i must claim half the interest/escrow/etc.....thgs that are on the 1098 FORM. The bank used to give me the amounts when it was Country Wide, but now that Bank of America has taken over they wont do it w/out authorization from him. Im just not sure what to do??? any advise would be awesome:)SmileSmile thanks so much

Hi mrmoore,

If the deed is in both the names, then you still have claims to that house. You should discuss the situation with an attorney and take his opinion in this matter.
