My husband owns a house with his brother and sister. They got a mortgage without his knowledge. If he is not on the mortgage, how can we find out how they got it. No one is talking to us. They tried to get him to sign, he would have been on the mortgage, but since he is not, HOW DID THEY DO IT? This a second question on a mortgage that I am asking.

Hi goldenangel,

I think they should have taken permission before taking mortgage as your husband is also an owner of the property. Are they asking your husband to pay anything for the mortgage payments?

Best of luck,
Larry

Hello goldenangel,

Do you want to have the property? Talk to your in-laws and if you do not want the property then ask them to buy you out. Means ask them to pay for your husband's share of the property and your husband can quitclaim to them.

Please update with your situation.

Here in Florida-all of that is public record. The internet is a wonderful tool. But sometimes you can find out a little too much info. If you search the county records in the area the property is in (recorded documents) chances are you will find what you are looking for. I did a search for my info one time and was baffled they showed EVERY document that was signed at closing including my rate. Like I said, the internet is great but some things I do like to keep private.

That was suppose to happen from the beginning. They decided to do it as a refinancing instead of a buyout. Less paper work and no lawyer. This is a sign of a mortgage fraud,as stated on the FBI web site. We never trusted they. My in law's son's both were arested for forging checks, one by the FBI and the families have done many other illegal things. I'm just glad my kids are in Delaware and are living honest lives. Now each sides lawyer's together are trying to sell the house. I just want this nightmare over, and stop these companies from doing this to others.

Hi goldenangel,

If you want to know whether the property is mortgaged or not I think you can try title search. That will help you find it out.

Best of luck,
Larry
