Hi, i have not made my mortgage payment since last july and now the lender Wells Fargo is takeing the case to court for foreclosure, i recived the court papers 2 weeks ago, i live in the state of DE which is judicial foreclosure state, how much time do i have to leave the house? ll i get a 30 day notice or just 3 days?

Welcome to Mortgagfit,

In my opinion you should not wait for any of the notice and you should voluntarily vacate the house.Surely you can ask them that you need some time to search for the new home,I don't think that they will not hear your plea in this regard.
Hopefully they should give you 30 days time period.

Hi Guest,

As far as I know, unless your property is foreclosed by the lender, you'll be able to stay in the property. After the property is sold off at the foreclosure auction, you'll receive an eviction notice after the sale of the property. The notice will mention the time period within which you'll have to leave the property.
