i am going through a divorce... i hired an appraiser in Jan. 2011 he took for ever to get me my appraisal... after several weeks and calls i finely got it back... $274,000..... i told the appraiser this price was redickulasly high... i pointed out many major issues with it. ( almost 3 year old comps., bigger homes on 5 achers and so on) he told me he had 22 years exp. and refused to do anything... so i hired a new appraiser and recieved it almost one month later the new appraisal came in at $196,400... do i have a case as he almost cost me $77,600 ...???

I don't think you have a case - an appraisal is just one appraisers opinions on your home's value.

Hi bruce,

Anyone can sue anyone. You can sue the first appraiser who has given you wrong figures. You should contact an attorney and check out whether or not you can take legal steps against the appraiser.

You may want to read a few of the older posts regarding law suits against an appraiser. While Adonis is correct that you can sue anyone for any reason, in order to WIN the suit, you will need to be able to prove an intent to mislead. Walking into court with nothing more than a disagreement with value won't cut it. You will have to prove that the appraiser lied with the intention to mislead you. There also must be a significant financial loss. Without a financial loss, you are only suing the appraiser for the cost of the appraisal fee.
