My father, mother and grandparents own a home together, the property is located in California. The Grant Deed reads as follows:

"John Doe and Jane Doe, husband and wife, Bob Smith and Sue Smith, husband and wife, ALL as joint tenants".

Bob Smith past away and Sue Smith (his wife) believes she gets his half, is this true? Is it not divided equally between the remaining tenants?

Sue Smith also believes that she can leave her half of the property to whom ever she wants too in her living trust, can she do this? Doesn't her half automatically go to John and Jane Doe?

In my opinion the property should be equally distributed,as the wording of the deed goes....But still in this case I will advice you to take a help of an attorney (preferably local) and he/she will be able to guide on the subject matter in a more detailed manner.
