i an going through a divorce and my exwife and daugher refuse to move out of the family home.both our names are on the mortgage, iam currently paying the full mortgage and maintenance for my 18month old daughter. how long do i have too keep payng the full mortgage?

Hi nutsdebbie!

Welcome to Forums!

As both your names are on the mortgage deed, you can ask your wife to pay 50% of the mortgage. You are not bound to pay the full mortgage. However, if she refuses or defaults on the payments, then you will have to pay the full mortgage unless its cleared so that you can save the house.

do i have too keep a roof over my daughters head until shes 18?
what happens when i have another family?
what happens when she has a boyfriend living there, do i still have to pay the morgage?

Until your daughter is 18 years age, she will be considered as a minor. Thus, she will never be able to take a mortgage or have her in the property deed. You will have to pay the mortgage till then.

let's get to the real meat of the matter. you signed a note when you bought the home promising to pay the mortgage. that means you must continue to pay the mortgage until it is paid in full.

as for providing a roof over your daughter's head, i hope and pray that you'll not feel that's a burden up to and beyond the age of 18. one would also hope that you've got enough influence in your daughter's life that her choice of boyfriend would be known to you prior to the actual existence of said boyfriend.

It will come down to the divorce decree as far as who needs to pay what. In the meantime, if she is not paying her part of the mortgage you only have two options. Continue to pay to save your credit. Or don't pay and ruin your credit. Right now, if your credit is important, I would just look at it as a cost to keep it good.

Your divorce attorney should be able to answer these questions for you and if they can't, I would get another one.

i dont mind paying the £100 aweek maintenance but why should i pay the full mortgage for my ex and her boyfriend to live there

Well if your name is on the mortgage docs, you need to pay the full mortgage. If you don't you will be ruining your credit. As your ex and her boyfriend will live there, you can ask them to refinance the property in their name.

Hey claire,

The owners of the property are liable to pay the maintenance fees. So if you are the property owner, you will have to pay the maintenance fees apart from paying the mortgage dues. However if there is another owner of the property, you can ask him/her to share the fees with you.
