divorced, house went to him, still in both our names, recently passed

My Ex just passed and though our house was given to him via divorce, it is still in both our names. It is under mortgage (also both our names) Legally, who does the house now belong to and if it does come to me (and our child) how do i claim it?

First how is the property title held? That will be the first place to look. Each way of holding property has a different way it handles this scenario. Is there a will?
