I want to claim a house my aunt died and left, but her son may have an interest in the matter...He opened a business soon after her death, and now he is busted and at rock bottom, homeless. He lost his own house, but my aunt's only is behind $1000 back taxes, no liens and has not been auctioned. How can you find out if a loan/mortgage is on a house you want to do a quick claim deed for?

You need to seek out a probate attorney. If she left no will saying who gets the home he probably has the first right to it over you.

Yes, I agree that it will come down to what the probate judge says. They will determine who gets what.
