The mortgage is in my spouse's name but the deed is in both names. My spouse passed away in January and now I am behind in my mortgage payments. Can I get a loan modification in my name even though the mortgage is not in my name. Can I assume the loan without having to refinance?

The lender may not agree to offer you a loan modification as your name is not on the loan. Nevertheless you should contact the lender and take his opinion in this mortgage.
