Hello my husband and I purchased a home 6 years ago with my mother in law. Two years ago she surprisingly moved out and decided not to pay.We have struggled since then to make our monthly payments. She refuses to do a loan modification or refinance. She finally agreed to do a short sale. But after signing and beginning the process she refuses to participate. Is there anything we can do. she is on the mortgage and the deed. Thank you

Hi one_love,

You can remove her from the mortgage by refinancing it in your name. However, you'll have to ask her to sign a quitclaim deed in order transfer the property in your name. Once she is out of the deed and the mortgage, you'll be able to short sale the property.
