Hi, My name is Bethy. I'm 13 years old. I'm not going to give details about myself but I NEED ADVICE!!!! I have an uncle who is an uninsured patient to a Health Care Settlement. I just recently (November 19, 2008) recieved a bill from the Administration. My family and I are ineligible to pay this bill or recive the threatened lawsuit. My father laid this upon me (not wanting anything to do with it) and I don't know how to reverse the "Claim Form" . I attempted to write a response letter but didn't send it afraid of unacuracy. The Notice states I can "opt out" of being a class member, but I'm unsure how. Finding this page on google, I decieded to get a word from the wise. What do I do? This is the only help I can recieve without being suided or recieving a very large bill. My uncle has no permanent settlement so I'm unaware of how to respond properly and safely. Can you help me? I apologize for the randomness of this message but it was a last resort.

As far as I can understand from your question, your uncle was a part of health care settlement but for may be some reasons, he did not get the facility. You being a minor, I don't think you have anything to do in this case. Moreover you or your family members will not be affected as I guess you all are not a beneficiary to the health insurance policy of your uncle. The best thing that your or your family members can do is to intimidate the state insurance department.
I appreciate your advice, but how do I "intimidate" the state insurance department? Another question also came up when I was reading the notice, I remember him also asking if I could lend him some money to help sue the health care department! I know it might be that he just want some extra money for reasons I'm not proud of but what I'm wondering is, might this have any relation to the letter?
You can inform the state insurance department by contacting them personally- giving them a call or informing them through a written application. It will be better if an adult from your family (i.e your father or someone else) does this because the department may not listen to a minor.
As far as claiming money for suing the health care department is concerned, there may a chance of an insurance fraud in your uncle's case. If any kind of insurance fraud had taken place, then your uncle needs to contact an insurance fraud attorney and take legal actions against the department.
Thank you for answering all of my questions. Again I appreciate all of the help this membership has provided. My father's convinced if we just leave it, it will go away, but I decieded we still needed a plan B.
I'll try to help my uncle understand the concept. I still have a few more questions to clear up some fog.
1) What are the rights I (My father and my uncle) have as far as contacting an insurance department?
2) What exacally would we "ask" for? How would I put the situation into a form of words that the people I'm contacting will understand?
3) My uncle is a criple with no education and no job, does he still have the legal rights as to getting the money that he doesn't deserve and will put other people in need into jeperity? I wish I could tell him to just cut it out but most of the time he's too drunk too deal with.

As your uncle is the beneficiary of the insurance policy, he should immediately contact the state insurance department. You have mentioned that he is ill. In that case your father can contact the state insurance department on his behalf.
You can show the details of the bills which you have received on behalf of your uncle to the insurance department. They will look into the matter and help you to know whether there is a insurance fraud involved in it or not. You may even take the advice of an attorney to deal with the authorities.
I can understand that your uncle is ill and I pray to God that he gets well soon. But getting money which he doesn't deserved is concerned, it is not a good idea.
