I,Raj kumar takes a Home loan of Rs.7,50000/- in 20/10/03. These days
my financial position not such I can't paying EMI since last 5 months due to several serious domestic problems.Divorce
is going on with my wife & she turned out me from my owned house now I want to sell out this flat and pay all loan amount to avoid increaseing panelties on me but she she doesn't leaves her possession
from that flat.

Welcome to the forum.

Do you mean that your wife doesn't want to leave the house? If you are the sole owner of the house, you can sell the house at your wish. Your wife cannot object you for this.

But you have mentioned that you are going for divorce. In that case, if your wife has made any claim on the house, then you cannot sell the house before the court proceedings are over.

And even if you wish to sell the house, you can ask the lender for any alternative repayment plan and thus can pay off the loan.

As divorce process has started you should wait for court decision on who will be given rights for the house.

It is quite possible that court gives your wife possession of the house.

So you need to wait and see what judgment is given by court.
